New Bills Propose Removal of PMs, CMs, and Ministers After 30 Days in Custody

The Indian government is set to introduce three new bills in Parliament that could have significant implications for elected officials facing serious criminal charges. The proposed legislation would allow for the removal of a prime minister, chief minister, or any other minister if they are held in custody for 30 consecutive days.

Under the provisions of the new bills, if an official is arrested and detained for 30 days on a criminal charge that carries a potential sentence of at least five years in prison, they will be automatically removed from their post on the 31st day.

The three bills to be introduced are:

  • The Constitution (One Hundred And Thirtieth Amendment) Bill 2025
  • The Government of Union Territories (Amendment) Bill 2025
  • The Jammu and Kashmir Reorganisation (Amendment) Bill 2025

Union Home Minister Amit Shah is expected to move a motion in the Lok Sabha to refer these bills to a joint committee of Parliament for further review.
